U.S. Marshal Cleared in Fatal Salt Lake Courtroom Shooting

THE DEPARTMENT OF JUSTICE WILL NOT PROSECUTE THAT U-S MARSHAL WHO FATALLY SHOT A DEFENDANT -- WHO RUSHED A WITNESS, DURING A FEDERAL COURT TRIAL -- IN SALT LAKE.

THE FBI, TUESDAY, ISSUED A STATEMENT SAYING IT CONSIDERS THE CASE CLOSED... AND WILL NOT RELEASE THE NAME OF THE MARSHAL.

AUTHORITIES SAY THE 25-YEAR-OLD DEFENDANT GOT OUT OF HIS SEAT, IN APRIL, AND TRIED TO STRIKE A WITNESS WITH A PEN.

THE MARSHAL FIRED FOUR SHOTS.... AND THE DEFENDANT LATER DIED AT A HOSPITAL.

NO ONE ELSE WAS INJURED.

POLICE SAY BOTH THE DEFENDANT AND WITNESS WERE MEMBERS OF THE SAME TONGAN CRIP GANG.
